Agreement – Binding Effect

By participating in American Hero Adventures’ (AHA) 9th Annual A Night of Honor auctions and raffles, each participant agrees to be bound by the following rules, and all other rules, terms and conditions that may be applicable to a specific auction or raffle item. These rules may be revised, amended, or corrected at any time in the sole discretion of American Hero Adventures (AHA), without prior or further notice.

The virtual silent auction will begin at 0900hrs PT on Saturday, 09Nov2024 and conclude at 1200hrs PT on Saturday, 16Nov2024. The in-person silent auction will begin at 1630hrs on Saturday, 16Nov2024 and conclude around 2200hrs that same day.

All travel arrangements necessary for participation in any adventure or trip with AHA shall be made through AHA, or its travel agent, only. There are no exceptions to this. There are several documents, including one or more waivers and releases, that all Participants are REQUIRED to sign as a condition to participation and attendance in any adventure or trip with AHA. Failure to timely and properly sign and deliver all documents requested of a participant shall be deemed a complete waiver of such participants right to attend or participate in any adventure or trip with AHA. No refunds, substitutions or exchanges shall be granted for any reason.

Auction

You are responsible for your bidder number and bidder card. If your card is raised or number called out, you are responsible for that bid. It is your responsibility to keep control of your bidder number and bidder card at all times. No refunds will be given if your bidder card is raised without your consent or knowing.

Payment

Payment for purchases can be made by credit/debit card (American Express, Discover, Master Card or VISA) online or by check, only.  No cash allowed. A $50 fee will be assessed if a payment method is declined or rejected for any reason. The subsequent attempt of payment will be accepted with a cashier’s check, only.

Retrieving & Shipping of Items

Auction items that are not shipped directly to the Winner from the donor/supplier can be picked up from AHA on Saturday, Nov 23rd and Sunday, Nov24th from 0900-1900hrs. Any items remaining after Nov 24th will be held for thirty (30) days and can be picked up by appointment, only, by calling (541) 246-8476. Items cannot be retrieved unless the Winner’s bill is paid in full. Any item(s) that need to be shipped can be shipped at the sole expense of the Winner, which must be paid in full prior to shipping. Any item(s) not picked up by the deadline will be deemed forfeited by the Winner. There will be no exceptions to this forfeiture. If you have any questions, or need to make special arrangements, please contact AHA before the deadline. AHA is not responsible for the storage and safe keeping of any item(s), or for any damage to, or loss thereof, after the deadline. See below for contact information.

Good, Services, Experiences, & Vacation Stays

Unless specifically stated otherwise, all goods, services, experiences, and vacation stays are valid for one calendar year from the date of the gala and must be booked no later than 1900hrs PT on Friday, 31May2025.

Firearms & Suppressors

Unless otherwise stated, firearms that do not need to be special ordered can be picked up from AHA or one if its affiliate FFL dealers beginning at 1100hrs on Saturday, 23Nov2024. Firearms and suppressors must be picked up from AHA or its affiliate FFL dealer no later than fourteen (14) calendar days after the Winner has been informed of their items being ready for pick up.  All state and federal laws must be complied with so the purchaser may take lawful possession of the firearm or firearm accessories and ammunition. Firearms can be shipped to an FFL of the Winner’s choice at the sole expense of the Winner, which must be paid in full prior to shipping, plus a $50 transfer fee. Winners of any pistol must be at least 21 years of age and Winners of any rifle or shotgun must be at least 18 years of age.

Winners of any suppressor must be at least 21 years of age. Winners of any suppressor must follow the provided protocol to obtain their suppressor. This information will be provided to those Winners within seven (7) calendar days of the Winner’s auction payment clearing. All Winners of suppressors are responsible for paying the $200 NFA tax stamp. Suppressors can be shipped to an authorized FFL of the Winner’s choice at the sole expense of the Winner, which must be paid in full prior to shipping, plus a $50 transfer fee.

All Sales Final

All sales are final! There will be no exchanges, refunds, or substitutions of any kind for any reason. No warranties, express or implied are made for the value or quality of merchandise or services or adventures auctioned, except those that may be offered by the manufacturer of an auctioned item. AHA has endeavored to catalog and describe the items correctly. However, all items are sold as is and how is based upon the Winner’s sole inspection.

Trip Insurance

It is highly advised for those who purchase a trip of any kind to purchase trip insurance from a qualified provider. There will be no exchanges, refunds, or substitutions of any kind for any reason.

No Warranties

Neither American Hero Adventures, nor the auctioneer, their respective agents, representatives, employees, staff, or volunteers warrant or guaranty the accuracy and completeness of any description, authorship, provenance, authenticity, or condition of any item. No statement in any written, digital, or oral statement, announcement, advertisement, or publication made at the auction or elsewhere at any time shall be deemed to create any express or implied warranty, representation, or assumption of liability. Participant(s) and purchaser(s) assume all risks associated in any way with their purchases.
